1. The agreement
These terms are an agreement between you and [Luzarc legal entity name], a company registered in India at [registered address] ("Luzarc", "we", "us"). They cover the website at luzarc.com and the application at app.luzarc.com (together, "the service").
If you use the service for a company or other organisation, you accept these terms on its behalf and confirm you have authority to do so. "You" then means that organisation.
2. Accounts and workspaces
You must be 18 or older to create an account. Keep your sign-in methods secure; you are responsible for what happens under your account.
An account belongs to a company. The company's administrators create workspaces, invite people and decide who can see each workspace. Administrators are responsible for the people they invite and for removing access when someone leaves.
3. Your content
Your content is everything you put into the service: scripts, prompts, dictated audio, uploaded images and references, characters, locations, objects and styles you create. You keep all rights to it.
You give us a limited licence to store, process and transmit your content only to run the service for you, including sending prompts and references to the model providers that generate your media. We do not sell your content and we do not use it to train models.
You confirm you have the rights you need in anything you upload, including the consent of any real person shown in it.
4. Generated output
As between you and us, you own the images, video and text the service generates for you, to the extent the law allows ownership of machine-generated material. Model providers may attach their own conditions to output; see section 7.
Generated output can be inaccurate, unexpected or similar to output made for someone else. Review it before you publish it, and label it as AI-generated where the law or a platform requires.
5. Acceptable use
You must not use the service to:
- make sexual content involving minors, or any content that sexualises a real person without consent;
- impersonate a real person or make deceptive depictions of them, including political deepfakes;
- infringe copyright, trademarks or other rights, or strip provenance from content you do not own;
- harass, threaten, or promote violence or hatred against people or groups;
- break the law of India or of the place you use it from;
- probe, scan or test the security of the service, reach another company's data, or get around usage limits or billing;
- resell access to the service, or use it to build a competing product, without our written agreement.
We may remove content or restrict features that break these rules. Model providers also run their own safety filters, and a request they refuse is not a failure of the service.
6. Credits and payment
Generation is paid for with prepaid credits. The price of credits is shown when you buy them. Before a job runs, Luzarc shows an estimate. The credits are held while the job runs, and when it finishes you are charged its actual cost, which can differ from the estimate. A job does not start if the balance cannot cover the estimate.
Payments are processed by our payment provider; we do not store full card details. Prices exclude applicable taxes, which are added at checkout. Purchased credits are not refundable except where the law requires, or where a job failed because of a fault on our side, in which case the credits are returned to your balance.
If you connect your own model-provider keys, you are also responsible for the charges that provider bills you.
7. Third-party models
Luzarc generates media and text through third-party model providers, including fal and OpenRouter, and the model makers behind them. Some models carry their own licence terms or usage policies, which apply to your use of that model. Which models are available can change as providers add and retire them.
8. Changes to the service
We improve Luzarc continuously, and features marked beta may change or be withdrawn. If we make a change that materially reduces what you have paid for, we will tell you in advance where we reasonably can.
We may update these terms. For material changes we will give notice by email or in the app at least 15 days before they take effect. Continuing to use the service after that means you accept the new terms.
9. Suspension and closing an account
You can close your account at any time. We may suspend or close an account that breaks these terms, puts other customers at risk, or is required to be closed by law. Where we can, we will tell you why first.
After an account closes, you have 30 days to download your films and assets. After that we delete your content, except what the law requires us to keep.
10. Warranties and liability
The service is provided "as is". We do not promise that it will be uninterrupted or error-free, or that generated output will meet a particular need.
To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose. Nothing in these terms limits liability that cannot be limited by law.
You will indemnify us against claims arising from your content or from your breach of section 5.
11. Governing law
These terms are governed by the laws of India. The courts of [city] have exclusive jurisdiction over any dispute.
